That there was newly dUcover- ed testimony, a. That the rase was argued, the jury charged and the ver dict brought in on a State holiday. On exceptions to tetimony sod His Honor's charge. The motion was overruled and de fendant appealed. Defendant then made a motion in arrest ol judgment on the ground that the bill of indict ment was insufficient in form. This motion was overruled, and defendant appealed . Judge Bynum withheld his decis ion until yesterday when sentence was pronunced, as already stated. During the delivery of the sentence the prisoner completely broke down. We presume, though we did not wt ness the trial, that the prisoner was lealously and ably defended, and that, on the other hand, the prosecu tion made the most ofthe evidence, wholly circumitancial as it was, to the conviction of the prisoner.
